These Terms of Service ("Terms") govern your use of the Flush mobile application ("the App"), operated by Verdix LLC ("we," "us," or "our"), a California limited liability company. By creating an account or using Flush, you agree to these Terms.
Flush is a golf scorekeeper, game format calculator, and group play management tool. Flush calculates game outcomes and displays results in units. Flush is a scorekeeper and calculator. It does not process, hold, or transfer payments. No money flows through the App. There is no payment integration, no wallet, no in-app currency, no escrow, and no "send payment" functionality. What users do with game results outside the App is entirely their own decision and responsibility.
You must be at least 17 years old to use Flush. By creating an account, you represent that you are at least 17 years of age. If we learn that a user is under 17, we will terminate their account.
You are responsible for maintaining the security of your account credentials. You agree to provide accurate information during registration, including your name and, if provided, your golf handicap. You may optionally provide a mobile phone number to allow other users to find and invite you by phone number and to receive transactional SMS (see Section 8). You may not create accounts for other people without their knowledge or consent.
You agree to use Flush only for its intended purpose: tracking golf scores, managing game formats, and engaging with AI coaching features. You may not:
Flush includes AI-powered features branded as "Condor." Condor provides golf coaching suggestions, course strategy advice, and game analysis. AI responses are generated by third-party language models and may not always be accurate. Condor is not a substitute for professional golf instruction, medical advice, or certified coaching. You use AI features at your own discretion.
The scorecard OCR feature uses AI to read handwritten scorecards. While we continually improve accuracy, OCR results may contain errors. You are responsible for reviewing and confirming all scores before they are recorded. Flush is not liable for disputes arising from incorrect score readings.
Flush calculates outcomes for various game formats (Nassau, Skins, Wolf, and others) based on the scores entered. These calculations are provided as a convenience. Flush does not adjudicate disputes between players. All game format rules and settlement terms are the sole responsibility of the participating players.
If you provide a mobile phone number, you consent to receive transactional SMS messages from Flush. These messages include verification codes, round notifications, and Tour Pool reminders. Flush does not send marketing or promotional SMS.
Message frequency varies based on your activity, typically 0–8 messages per week. Message and data rates from your mobile carrier may apply. Flush does not charge for SMS messages.
You may opt out of SMS at any time by replying STOP to any message. You may text HELP for help. Removing your phone number from your profile in the Flush app will also stop all SMS.
Flush uses Twilio Inc. as its SMS delivery provider. Your phone number is shared with Twilio solely to route messages you have consented to receive. Flush does not sell, rent, or share your phone number with any third party for marketing or promotional purposes. See the Privacy Policy for additional detail.
By enabling push notifications on your device, you consent to receive notifications from Flush. Notifications fall into five categories: Account & Security, Your Group, Tour Pool, Streaks & Condor, and Product Updates. You may control which categories you receive in the Flush app under Settings → Notifications. The Account & Security category cannot be disabled while the app is in use, as these notifications are required to maintain account security. All other categories may be disabled at any time.
We aim to send no more than one push notification per day on average across all categories. Notifications are delivered through Apple Push Notification Service (APNs) on iOS or Google Firebase Cloud Messaging (FCM) on Android via the Expo push notification relay service. Delivery is not guaranteed and depends on factors outside of our control, including device availability and network conditions.
You may disable all push notifications at any time by toggling the master switch in Settings → Notifications, by revoking notification permission in your device's system settings, or by deleting your account. Disabling push notifications does not affect any other Flush functionality. Flush does not sell, rent, or share your push notification token with any third party. You retain ownership of all content you submit to Flush (scores, names, profile data). By using Flush, you grant us a limited license to store, process, and display your content as necessary to provide the service. We may use anonymized, aggregated data for product improvement and analytics.
Flush, Condor, Flush Score, Flush Index, The Docket, and all related branding are trademarks of Verdix LLC. The App's design, code, and content are protected by copyright. You may not copy, modify, or distribute any part of the App without our written permission.
FLUSH IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OF AI-GENERATED CONTENT, OCR RESULTS, GAME CALCULATIONS, OR THE TIMELY DELIVERY OF PUSH NOTIFICATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERDIX LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF FLUSH. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless Verdix LLC from any claims, damages, or expenses arising from your use of Flush, your violation of these Terms, or any dispute between you and other users regarding game outcomes or settlements conducted outside the App.
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use Flush ceases immediately and your push notification token is removed from our systems.
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Los Angeles County, California.
We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of Flush after changes constitutes acceptance of the updated Terms.
